Quick Summary of the Alabama Workers' Compensation Act (AWCA)

AWCA provides financial assistance, medical care and other benefits to workers who suffer a job-related injury or illness.

AWCA applies to employers with 5 or more employees — includes full-time and part-time employees, officers of a corporation and members of an LLC.

  • Applies only to employees and not independent contractors

Generally requires employers to carry insurance or qualify as self-insured organization

Does not mandate leave time; however, leave is impliedly considered part of receiving medical treatment for injuries arising out of and in the course of employment.

Does not require employers to accommodate medical conditions

AWCA prohibits retaliatory discharge

Alabama Department of Labor administers law

Disputed claims in Alabama are handled in Circuit Courts
